We can provide a Protective Distraint, where a Bailiff Company Certificated Bailiff will attend at the demised premises, make an inventory of goods and take photographs. We also security mark the goods. A Walking Possession agreement will be made with the tenant. The landlord has then protected assets against arrears. The landlord becomes the preferred creditor, in front of HMRC. The landlord has security, the tenant continues to trade and pay rent as and when due.
We can provide a Standard Distraint, a Bailiff Company Certificated Bailiff will attend the demised premises without notice. He will make an inventory of stock, take photographs and security mark all items levied upon. The Bailiff will collect the arrears of rent (and our fees) from the tenant or give the tenant 5 days Walking Possession to allow him time to pay all the arrears. In the event that the arrears go unpaid, the goods levied upon would be seized and auctioned to recover the outstanding debt. Be reassured that only around 3% of tenants let the arrears go unpaid and have their stock removed. Most pay when faced with one of our fully trained, authorised and Certificated Bailiffs.
We can provide a forfeiture of lease, a Bailiff Company Certificated Bailiff will attend at the demised premises with a qualified locksmith. The locks will be changed and the premises secured. We attend instructions immediately. We deal with any goods in the premises under the Interference with Goods legislation.
